GENERAL
The LICENSE AGREEMENT AND WARRANTY DISCLAIMER apply to all film offers, contracts, supplies and other achievements. They are recognized with conclusion of a contract, at least with the receipt of the commodity or achievement.
Any contradicting trading conditions of the customer, contracting party or user are considered as impossible. Changes and additions of the general trading conditions do only apply if they are confirmed written. Area of jurisdiction for all disputes in connection with the delivery business, the rights to use, license and in the change and cheque procedure is Berlin.
Only german rights apply exclusively to contracts with INFILM.
TRADING AND PAYMENT CONDITIONS
1. INFILM commits itself to accept the order of the customer to the general trading conditions. INFILM is justified to resignation, while write, print and calculation errors occure on the web content.
2. If not agreed differently, the commodity will be sent over to the ship-to-address indicated by the orderer. The risk is taken over by the orderer, as soon as the commodity was handed over to a parcel or delivery service. Times for delivery are noncommittal.
3. The purchase price becomes immediately due after receipt of the confirmation E-Mail, at least with receipt of the commodity. The orderer can select thereby between account drawing, cash on delivery and credit card charge. Up to the complete payment of all requirements existing against the orderer the supplied commodity remains property of INFILM.
4. In case of delay of payment INFILM is justified to demand over interests at a value of 3% above the basis interest rate per annum.
5. INFILM is not responsible for any damage during transport of the commodity. A warranty on commodity ordered with INFILM does not exist. If INFILM negligently hurts a contract-substantial obligation, the obligation to indemnify is limited to the more typically developing damage.
LICENSE AGREEMENT
1. Conditions for acceptance of films
- INFILM accepts films of all categories in principle, if they are artistically and technically sophisticated and original. INFILM does not want to be considered as a platform for publications of "HomeMovies" e.g. video with cuts of weddings and birthdays. In principle films with discriminating, racistic, anti-semitic or strange-hostile contents are not to be published. The range of hardcore pornography is likewise impossible.
- INFILM is justified to accept the offer of the film producer within 3 months starting from entrance of the film. Afterwards the offer expires to this period. INFILM is only obligated to send the contribution back if a sufficiently franked back transmission envelope is settled.
- The film producer sends INFILM the application form, filled out and signed, the film and if necessary back postage. We accept films of every genre that do not exceed a running length of 20 minutes. Submit your film on this variety of media: DV, DVCAM, miniDV, VHS, S-VHS, U-Matic (PAL), BetacamSP (PAL), DVD and CD-ROM/DVD-ROM - in all common file types and codecs.
2. Rights for use / Right Transmission
- The film producer transfers INFILM the spatially unrestricted right to use the film non-commercially in both low-band and broad-band on-line media for streaming and downloading to make it available. If necessary, the right is also transferred for duplication. The film producer is entitled to grant further SIMPLE and NOT EXCLUSIVE RIGHTS OF USE. With the acceptance of the offer the rights of use will transfer to INFILM as described above.
- Any further commercial use of the film needs the permission of its producer.
- The film producer can be participated in any commercial use of the film by Infilm.
- Any profit of a commercial use of the film can be shared with the film producer. This will be concluded in a special contract between Infilm and the film producer.
- The film producer transfers the rights for a period of at least 3 years.
3. Guarantee
- The film producer guarantees that he has all rights for use of the film, which form the subject of the right transmission. The film producer commits itself to preserve INFILM from any claims of thirds because of a possible injury of author rights, rights for use or personal rights.

INFILM does not guarantee for the topicality, the correctness, completeness or quality of any available content and offer. INFILM expressly dissociates itself from contents, which were brought in by thirds.
Liability claims against INFILM, which were caused by the use of incorrect or incomplete information, are excluded, if no deliberate or roughly negligent behaviour to blame for is present as can be proved.
